Boarding Agreement

All horses are separated into mares and geldings unless private turn out is requested. Stallions require private turn out. For the comfort of all horses they will be turned out in the daytime in the winter months and at night during the summer months, unless otherwise stated.
Statesman Farm agrees to provide normal and reasonable care to maintain the health and well-being of said horse. All horses are fed twice a day and given hay as needed. In the Winter months all horses will receive a weekly warm bran mash. If your horse receives supplements they must be ordered in “SmartPaks” or divided into daily doses by you, labeled with your horses name and time to be given in either plastic containers and/or sandwich bags; this is to avoid confusion and keep your horse receiving what he/she needs at all times. Optional Special Instructions:
While this horse is boarded at Statesman Farm, Statesman Farm shall not be liable for any sickness, disease, theft, death or injury suffered by the horse(s) or any other cause of action arising from or connecting to the boarding of this horse. All risks are assumed by the Owner. The Owner agrees to hold Statesman Farm harmless from any loss or injury to said horse(s). All costs, no matter how catastrophic, connected with boarding are borne by Owner.
Owner agrees to hold Statesman Farm harmless from any claim caused by said horse(s) and agrees to pay legal fees incurred by Statesman Farm in defense of a claim resulting in damage/injury by said horse(s).
If medical treatment is needed, Statesman Farm will attempt calling Owner but, in the event Owner is not reachable, Statesman Farm has the authority to secure emergency veterinary and/or blacksmith care. Owner is authorizing Statesman Farm to secure care for said horse up to the amount of _________________ and has authorized Statesman Farm as Owner’s agent to arrange billing to the Owner.
Statesman Farm agrees to implement a shoeing and worming program, consistent with recognized standards. Owner is obligated to pay the expenses of such services, including a reasonable stable charge if Owner is unavailable to hold said horse. A check or cash must be left for shoes/trim prior to being done.
Owner warrants that he owns the horse and will provide, prior to the time of deliver, proof of a negative Coggins test.
Either party may terminate this agreement. In the event of a default, the wronged party has the right to recover attorneys’ fees and court costs, resulting from this failure of either party to meet a material term of this agreement.
Owner agrees to give Statesman Farm thirty (30) days notice to terminate this agreement. Also, the Owner cannot assign this agreement to any other party unless Statesman Farm agrees in writing (separate boarding contract).
Statesman Farm has the right of lien as set forth in the law of the State of Maryland for the amount due for board and additional agreed upon services and shall have the right, without process of law, to retain said horses(s) until the indebtedness is satisfactorily paid in full.
This agreement is subject to the laws of the State of Maryland.
